The license allows you to use CPLEX in all the intended ways. This for example includes linking against the CPLEX (shared) libraries. I guess that is what your "other" software is doing? If not then please provide more details about what this other software is doing.

Yes the idea is to share CPLEX Solver .dll file with another program. I understand if there is a library provided by the CPLEX optimization software/ILOG it is not possible to use it for other purposes. But the cplex solver belongs to IBM and I am not sure if usage of this solver restricted by the license agreement.

Under the Academic Initiative program (I am specifically referring to section 2 in https://developer.ibm.com/academic/docs/legal-agreements/august-2016-academic-initiative-program-agreement/), you can distribute the program only to your students if you're a teacher, and you can use the program for teaching and research only.   If the other program would only be used under these conditions, then you can include (parts of) CPLEX Optimization Studio in it.  But any other use is prohibited.

For example, making any part of CPLEX available to anybody that's not one of your students (and, if you're a student, you don't have students) is prohibited.
